New York Marriage Equality Act can Affect the Tax Treatment of Benefits


The New York Marriage Equality Act legalized same-sex marriage in New York State effective July 24, 2011.  Legal recognition applies to all legally performed marriages, whether or not the marriage took place in New York. 

MCC employees who have Domestic Partners on their health and dental plans and choose to marry under this new law should report their marriage to Human Resources, as it will change the tax treatment of their Domestic Partner coverage.  Once married, the financial worth of the Domestic Partner’s health insurance benefit will be considered a pre-tax benefit for New York State tax only.
