Legal Obligations under the Americans with Disability Act (ADA) and Section 504 of the Rehabilitation Act

Purpose Statement
Monroe Community College provides a mainstreamed learning environment for students who identify themselves as having a disability. Students are responsible for informing the College of their individual needs, and must provide the appropriate accommodation documentation for services. Reasonable accommodations are available to students who meet the academic and technical standards required for admission or participation in the education program or activity, with or without the provision of academic adjustments and/or auxiliary aids. In accordance with the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act of 1973, the College ensures that all educational opportunities offered are fully accessible to and usable by qualified students with disabilities. The Disability Services Office is the designated department responsible for maintaining all student disability related documentation, certifying eligibility for receipt of services, determining academic adjustments on a case-by-case basis, and ensuring provision of those services.

Faculty/Staff Responsibilities
All faculty and staff hired by the College are obligated under the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act to provide the approved accommodations listed on an Academic Accommodation Letter. Students have a right to privacy and all disability related information should strictly be kept confidential. Please refrain from having a conversation with a student with a disability in an environment where others may become privy to the information. Faculty "cannot deny, restrict, and/or interfere with approved accommodations unless the accommodation fundamentally alters an essential learning outcome". Faculty who identify an accommodation to fundamentally alter an essential learning outcome are required to contact the Disability Services Office as soon as possible to engage in a thorough dispute resolution process.

Note: while determining if an accommodation is a fundamental alteration, the accommodation must be provided pending resolution of the dispute.

Please refer any student who attempts to provide their disability documentation directly to you and/or asks for accommodations without providing an Academic Accommodation Letter to the Disability Services Office.

For additional information, please refer to the Faculty Resource Guide: Supporting Students with Disabilities and/or contact the Disability Services Office.
