Sexual Harassment Is Not Tolerated at MCC

In light of Governor Andrew Cuomo’s resignation yesterday, let us all be reminded that MCC employees and students are entitled to work and learn in a campus environment that prevents and protects them from sexual harassment.

Sexual harassment against an employee or a student is a form of discrimination and this grossly negligent level of misconduct will not be tolerated (MCC policy). 

I echo Chancellor Jim Malatras’ statement that sexual harassment is “inexcusable behavior … This is not the culture of SUNY, nor would it ever be tolerated at any level. Sexual harassment and assault in any of its ugly forms should never be allowed in the workplace or anywhere in our society.”

Sexual harassment is generally described as unwelcome sexual advances, requests for sexual favors or other verbal or physical conduct of a sexual nature when:

  • Submission to such conduct is made (either explicitly or implicitly) a term or condition of employment or academic benefit; or
  • Submission to or rejection of the conduct is used as the basis for an employment or academic decision affecting the person rejecting or submitting to the conduct; or
  • The conduct has the purpose or effect of unreasonably interfering with an affected person’s work or academic performance, or creating an intimidating, hostile or offensive work or learning environment.

Such behavior can constitute sexual harassment regardless of the sex, gender, sexual orientation, self-identified or perceived sex, gender expression, status of being transgender, or gender identity of any of the persons involved.

Preventing sexual harassment is everyone’s responsibility.

MCC cannot prevent or remedy sexual harassment unless the College knows about it. Any employee or student who has been subjected to behavior that may constitute sexual harassment is encouraged to report such behavior to a supervisor, manager or Human Resources. Anyone who witnesses or becomes aware of potential instances of sexual harassment should report such behavior.

Reports of sexual harassment may be made verbally, in writing, or using an online report form. Employees who are reporting sexual harassment on behalf of other employees should use the form and note that it is submitted on another employee’s behalf.
