SUNY Sanctions Apply to Students Who Fail to Comply with Mandated Pooled Testing

Dear Campus Community,

Chancellor Dr. Jim Malatras and SUNY leaders have announced new SUNY-wide required student conduct sanctions associated with specific COVID-19 violations. These requirements complement MCC's General Conduct Rules and Regulations during the pandemic.

Effective today, October 1, 2020 at 8 a.m., SUNY universities and colleges, including MCC, must adhere to an emergency directive calling for uniform sanctions in response to COVID-19 safety violations by students. This directive applies during our response to the COVID-19 pandemic and will end on the order of Chancellor Malatras.

Students will be sanctioned if they are found to be responsible for any of the following:

  • Test positive for COVID-19 and then intentionally expose others to the virus;
  • Fail to adhere to isolation or quarantine orders;
  • Host or attend a prohibited on- or off-campus gathering;
  • Fail to follow face-mask and social-distancing requirements;
  • Fail to comply with COVID-19 contact tracing efforts; or
  • Fail to attend at least two scheduled appointments, without a sufficient excuse, to obtain diagnostic or surveillance COVID-19 testing (pooled testing).

Why is it important for students to keep pooled testing appointments?
According to section VI-Failure to Comply with Campus Health Protocols of SUNY's COVID-19 sanctioning policy, "students who fail to attend at least two scheduled appointments, without sufficient excuse, to obtain diagnostic or surveillance COVID-19 testing under the institution's published protocol, the institution shall undertake disciplinary action to enforce compliance." Mandated sanctions may include interim suspension or administrative, non-disciplinary actions such as restricted or reduced access to campus facilities and buildings, inability to attend in-person classes, parking restrictions, etc. The full sanction is available online.

All student conduct reports are reviewed on a case-by-case basis. All students maintain the due process rights guaranteed to them by the federal and New York state constitutions, state law, SUNY regulations, and campus policies.
